1. Our Commitment to Privacy
Agentiiv Inc. ("Agentiiv," "we," "us," "our") is the Program Administrator for the You.Scaled. Accelerator Program (the "Program"). We are committed to protecting the privacy and security of the information entrusted to us by every applicant ("Applicant," "you," "your").
This Privacy Policy ("Policy") explains how we collect, use, disclose, and protect Personal Information through the Program's online application form. For the purposes of this Policy, "Personal Information" means any information about an identifiable individual, as defined under applicable Canadian privacy legislation.
This Policy is an integral part of the Program's Terms and Conditions. By submitting an application to the Program, you consent to the collection, use, and disclosure of your Personal Information as described herein.
2. Accountability and Governance
Agentiiv is responsible for all Personal Information under its control. We have appointed a Privacy Officer who is accountable for our compliance with this Policy and applicable privacy laws. You may contact our Privacy Officer with any questions or concerns using the contact information provided in Section 12.
3. Information We Collect and Our Purposes
We limit the collection of Personal Information to what is reasonably required to administer the Program. We collect the following types of information for the specific purposes outlined below:
- Identity and Contact Data: We collect your first name, last name, company email address, and phone number. The purpose of collecting this information is to communicate with you regarding your application, including sending updates, requests for additional information, and notifications about the status of your application.
- Business Profile and Eligibility Data: We collect your company name, industry sector, website, primary location, years in operation, Canadian registration status, and your calculated Full-Time Equivalent (FTE) employee count. The purpose of collecting this information is to verify that your organization meets the specific eligibility criteria for the Program as defined in the Terms and Conditions.
- Operational and Strategic Data: We collect your responses to questions regarding your organization’s Current Challenges, Technology Usage, 12-Month Objectives, Current Roadblocks, and desired Automation Tasks. The purpose of collecting this information is to assess your application against the "AI Readiness" and "Implementation Plan" evaluation criteria.
- AI Readiness and Impact Data: We collect your responses regarding your team's Tech Comfort, your Data Practices, your Change Management experience, and your potential Community Value and Economic Contribution. The purpose of collecting this information is to assess your application against the "AI Readiness" and "Canadian Impact" evaluation criteria.
- Voluntary DEI Data: We invite you to optionally self-identify in categories such as Woman-led, Indigenous-led, or 2SLGBTQI+ led, among others. The sole purpose of collecting this data is for aggregated statistical analysis. This data is used on an anonymized, aggregated basis to monitor the Program's reach and ensure equitable evaluation. This information is not used in the evaluation of your individual application and has no bearing on its outcome.
- Technical Data: When you use the online application form, we may automatically collect technical information, such as your IP address, browser type, and device information, through security tools like reCAPTCHA. The purpose of collecting this information is to protect the integrity and security of the application process and to prevent fraud.
4. Consent
By submitting an application to the Program, you provide your express consent for Agentiiv and its Program partners to collect, use, and disclose your Personal Information in accordance with this Policy.
You acknowledge that your consent to the sharing of your application with the full Selection Committee, as detailed in Section 5, is a mandatory and non-severable condition of participation.
You may withdraw your consent at any time by contacting our Privacy Officer. However, the withdrawal of your consent will result in the withdrawal of your application from the Program.
Please note that consent for marketing communications (Email and SMS) is obtained separately within the application form and is not a condition of applying for the Program.
5. Disclosure of Information to Third Parties
We will not disclose your Personal Information to third parties except as set forth below:
- Program Partners and the Selection Committee: Your complete application and all associated data will be disclosed to the Program's Selection Committee for the sole purpose of evaluating your application. You acknowledge that the Selection Committee is composed of representatives from both Agentiiv and its third-party Program partners. All members of the Selection Committee are contractually bound by strict confidentiality and data protection obligations that require them to handle your information with the same level of care as Agentiiv.
- Service Providers and Subprocessors: We may engage third-party service providers to perform functions on our behalf, such as data hosting and application management. We ensure that such providers are contractually obligated to maintain the confidentiality and security of your information and are restricted from using it for any purpose other than to provide services for us.
- As Required by Law: We will disclose Personal Information if required by law, court order, or a subpoena, or if we believe in good faith that such disclosure is necessary to protect the rights, property, or safety of Agentiiv, our users, or the public.
6. Data Security Safeguards
We have implemented administrative, technical, and physical safeguards to protect the Personal Information in our custody and control against unauthorized access, use, modification, and disclosure. These measures include, but are not limited to:
- Technical Safeguards: Use of encryption, firewalls, and secure server environments.
- Administrative Safeguards: Internal policies and procedures that limit access to Personal Information to authorized personnel on a "need-to-know" basis. All personnel and partners with access to your information are bound by strict confidentiality obligations.
7. Cross-Border Data Transfers
While our primary data storage is within Canada, some of our service providers may be located in other jurisdictions. As such, your Personal Information may be transferred, stored, or processed in the United States or other countries. While your information is in another jurisdiction, it will be subject to the laws of that jurisdiction, including laws that may permit law enforcement to access it.
8. Data Retention
We will retain your Personal Information only for as long as necessary to fulfill the purposes for which it was collected and to comply with our legal obligations. Our retention periods are as follows:
- For Successful Applicants (Recipients): Application data will be retained for the duration of the Grant Term and for three (3) years thereafter for program administration and auditing purposes.
- For Unsuccessful Applicants: Application data will be retained for two (2) years after the end of the Application Period for statistical analysis, after which it will be securely and permanently destroyed or anonymized.
9. Your Rights and Access to Information
You have rights regarding your Personal Information. Subject to applicable law, you may:
- Request Access: You have the right to request access to the Personal Information we hold about you.
- Request Rectification: You have the right to request the correction of any information you believe is inaccurate or incomplete.
- Withdraw Consent: You have the right to withdraw your consent to our processing of your information, subject to legal or contractual restrictions.
To exercise any of these rights, please submit a written request to our Privacy Officer.
10. Inquiries and Challenging Compliance
We are committed to resolving any questions or concerns you may have about our privacy practices. If you have a question or complaint, please first contact our Privacy Officer.
If our Privacy Officer is unable to resolve your concern to your satisfaction, you have the right to file a complaint with the Office of the Privacy Commissioner of Canada. Information on how to file a complaint can be found at www.priv.gc.ca.
11. Changes to This Privacy Policy
We may update this Policy from time to time to reflect changes in our practices or legal obligations. We will post any changes on the Program website and indicate the date of the last update.
